Limitation of Liability
Effective June 1, 2026
This policy supplements Section 16 of the Terms of Service and must be interpreted consistently with it. If this policy conflicts with the Terms, the Terms control.
1. Excluded damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MULTITEL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CONTENT, OR COMMUNICATIONS, EVEN IF ADVISED OF THE POSSIBILITY.
2. Aggregate limit
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MULTITEL'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT THE CUSTOMER PAID MULTITEL FOR THE AFFECTED SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
3. Scope and non-waivable rights
The limitations apply regardless of the form of action and to service interruptions, routing or delivery failures, number loss, porting delays, emergency-service limitations, unauthorized access, third-party networks, and data loss, except to the extent a limitation is prohibited by applicable law. Nothing in this policy excludes liability or a remedy that cannot lawfully be excluded or limited, including any non-waivable consumer right.
